Site Use

1.1 License of Use

The client is granted a limited, non-transferable, non-exclusive, personal, and revocable license to use the site, as long as they maintain agreement with these terms. If the user is under 18 years of age, has a cognitive impairment, or other condition that prevents them from being responsible for these terms, they must use the site accompanied by a responsible family member.

Our current presence is available in the United States and Mexico markets.

We make no representation that any material on the Site is appropriate or available for use outside the Applicable Markets, and access from territories where its content is illegal is strictly prohibited. All references on the Site to specific services or products apply only to those available in the Applicable Markets, and all statements and comparisons with other products on the Site correspond only within the Applicable Markets. Those who access the Site from other locations do so on their own initiative and are responsible for compliance with local laws, such as laws regarding the transmission of technical data exported from the United States or the territory in which they reside.

1.2 Limitation of Use

We reserve the right to deny service at our sole discretion and without notice. You are fully responsible for your use of the Site and agree to indemnify, hold harmless, and defend us from any claim, damage, loss, liability, cost, and expense, including attorney's fees, resulting from your use or misuse of this Site. Posting or transmitting any illegal, infringing, threatening, defamatory, obscene, indecent, inflammatory, pornographic, or profane material, or any material that may be considered or promotes conduct that could be considered a criminal offense, gives rise to civil liability, or otherwise violates any law, is strictly prohibited.

No material from our Site may be copied, reproduced, republished, downloaded, posted, displayed, transmitted, or distributed in any form without the prior written permission granted through specific agreements. Downloading copies of materials is permitted only for personal computers, for private home use, not for commercial purposes, provided that copyrights are respected and the material is not altered in any way.

You may not, without our prior written permission, frame or replicate any material contained on this Site on any other server. Unauthorized use of any of these materials on any other website or computing environment is expressly prohibited. All trademarks, service marks, trade names, sub-brands, and trade dress are the property of iEvolution or its licensors, sister companies, and affiliates.

1.3 User Information

By using our site, you accept the use of your personal information under the protection standards of our Privacy Policies, which you accept by using these terms and conditions.

1.4 User Identification

It is your responsibility to safeguard the password you use to access our Site and to notify our customer service as soon as possible if you ever suspect that your password has been compromised. We recommend that you change your password regularly to prevent unauthorized access. Because your identification number and password are specific to you, you acknowledge that you are solely responsible for any use of our site made with your identification number and password.

1.5 Intellectual Property

All elements that make up the site are the property of iEvolutionPro LLC, notwithstanding that their publication is a use and not a concession, whereby all rights to whatever the site contains remain under iEvolution's private decision. You do not obtain ownership rights in any of said elements viewed through the Site. Except as otherwise indicated herein, none of these elements may be used, copied, reproduced, downloaded, published, displayed, transmitted, modified, or distributed in any form or by any means, including, without limitation, electronic, mechanical, photocopying, recording, or any other means, without the prior written permission of iEvolution.

1.6 Termination

These Terms shall be in effect until termination by iEvolutionPro LLC. Your rights under these Terms will be automatically terminated if you fail to comply with any of the terms.

User Content

2.2 Content

All information, data, text, software, music, sounds, photographs, graphics, videos, messages, products, services, and other materials ("Content") posted on the Site by users, including you, is the sole responsibility of the person who posted the Content. This means that you, and not us, are solely responsible for all Content that you upload, post, transmit, or otherwise make available through or on the Site. You are solely responsible for all Content posted under your user account.

You represent and warrant that:

In the event that the Content is deemed illegal, we will cooperate with the appropriate authorities, including, without limitation, the delivery of all necessary information. If we determine, at our sole discretion, that any Content you post is offensive or inappropriate, we may immediately remove it or request that you remove or modify the Content in question. If you fail to comply with our request within the specified time, we may remove the Content. We have no obligation, however, to restrict or monitor the Content in any way; it remains your responsibility. Such decision, on our part, may require explanation but will not be open to claims.

We do not control the Content posted on or through the Site by third parties and, therefore, do not guarantee the accuracy, completeness, or quality of such Content. You are solely responsible for all use of or reliance on the Content, including those related to its accuracy, completeness, or usefulness.

You acknowledge that we have no obligation to pre-evaluate the Content, but that we and our representatives shall have the right (but not the obligation), at our sole discretion, to reject or remove any Content that is available through the Site. Without limitation of the foregoing, we and our representatives shall have the right to remove any Content that violates these Terms or any other company policy, or that is otherwise objectionable at our sole discretion.

Any material, information, or idea that you submit to us or to the Site by any means may be disseminated or used by us without compensation or liability to you for any reason, including, without limitation, development, manufacturing, and marketing of products. We have no obligation to keep any submission confidential, return any material you submit to us, or compensate you for the use of any such materials under any circumstances. You hereby irrevocably waive all claims based on our use of any material, idea, or information you submit to us.

We reserve the right to monitor compliance with these Terms in some, all, or none of the areas of the Site. You agree that by providing you with the ability to post information on the Site, we are acting as passive conduits for distribution and are not accepting any obligation or responsibility related to any posting or activities on the Site.

We do not assume ownership of the Content you upload, place, or publish through the Site. You are responsible for protecting your rights to such Content and have no right to receive our assistance in protecting said Content. By uploading, placing, or publishing Content through the Site, you grant us a perpetual, irrevocable, royalty-free, non-exclusive, and fully non-transferable license, under any intellectual property or other rights, including without limitation, privacy and publicity, use, distribution, reproduction, modification, adaptation, translation, public performance, public display, exploitation, creation of derivative works from the Content (in whole or in part), and incorporation of said Content into other works in any format or medium now known or hereafter developed, for any purpose associated with the Site. You grant us and our sublicensees the right to use the name you submit in connection with said Content, if we so choose. You hereby irrevocably waive any claims of "moral rights" and similar theories, if any. Note, however, that certain activities (for example, contests) involving the submission of Content by you may have terms applicable to your Content that are different from the foregoing. In the event that such terms differ from these terms, such terms shall govern and take precedence over these terms in relation to your Content.

Content used in special promotions may be governed by its own conditions.

Code of Conduct

3.1 Authorization of Use

Your authorization to use the site and contribute to it depends on your compliance with the community standards established by the company and the codes of conduct set forth below. In the event that behavior does not correspond with these, we may revoke partial or total use privileges of the site and take measures to enforce certain standards.

3.2 Rules of Conduct

Below we list the main behaviors not permitted on this site, without prejudice to reserving the right to decide, in specific cases, that an identified behavior, although it does not break with the present list, must be sanctioned for equally breaking with morality and good customs:

• Upload, post, transmit, or otherwise make available Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of the privacy of others, false, fraudulent, or openly contrary to compliance as known in the company's industry, that promotes hatred, xenophobia, or is otherwise objectionable.
• Cause harm to minors in any way.
• Impersonate any person or entity, including, but not limited to, any of our members, company officers, directors, shareholders, agents, representatives, or users, or falsely state or otherwise misrepresent your affiliation with a person or entity.
• Forge headers or otherwise manipulate identifiers to conceal the origin of any content posted, transmitted, or otherwise made available through the Site.
• Upload, post, or otherwise transmit any Content that you have no right to upload, post, or transmit under applicable laws or contractual or fiduciary relationships (such as privileged, protected, and confidential information accessed or disclosed as part of employment relationships or under confidentiality agreements). The breach of confidentiality as Content is not a behavior shared by our corporate values and will be treated as a corresponding violation.
• Upload, post, or otherwise transmit any Content or otherwise participate in activities that infringe, violate, or interfere with patents, trademarks, trade secrets, copyrights, privacy or publicity rights, or other proprietary rights of any party.
• Upload, post, or otherwise transmit materials containing application viruses, trojans, malware, or any other computer code, files, or programs designed to alter, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment, or to intercept messages sent from a computer or communication device.
• Interfere with or create problems on the Site, servers, or networks connected to the Site, or disobey any requirements, procedures, policies, or rules of networks connected to the Site.
• Intentionally or unintentionally violate applicable local, state, national, or international laws, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, the rules of any national or other securities exchange, including, but not limited to, the New York Stock Exchange, the American Stock Exchange, or NASDAQ, and any regulations having the force of law.
• "Stalk" or otherwise harass another person.
• Promote or provide instructional information about illegal activities, encourage physical harm or injury against any group or person, or encourage any act of cruelty against animals. This may include, without limitation, providing instructions on how to assemble bombs, grenades, and other weapons or incendiary devices.
• Offer for sale or sell any item, merchandise, or service through our Site.
• Use the Site as a forwarding service to another website.
• Allow third parties to use it in a manner that violates these Terms or any other iEvolution policy.
• Take measures to interfere with or compromise our security measures in any way.
• Use the site for fraudulent purposes.
• Collect or gather any information about other Account holders, including, but not limited to, personal information or data.
• Sell, lease, rent, exchange, sublicense, assign, transfer, or otherwise grant rights to your account or password, including, but not limited to, through the use of any third-party website or service.
• Copy the Site or any portion thereof (other than as provided under U.S. copyright laws).
• Remove from the Site any notice of registered information.
• Cause, permit, or authorize the modification, creation of derivative works, or translation of the Site without our express consent.
• Sell, assign, rent, lease, act as a service bureau, or confer rights related to the Site, including, but not limited to, granting sublicenses to any other person or entity.
• Attempt to decompile, reverse engineer, disassemble, modify, or illegally access the Site or disable or seize digital rights management technology or encryption technology that we have implemented with respect to the Site or the information that the Site or we transmit, process, or store.
• Offend, defame, verbally attack, threaten, or damage the reputation of the company, the corporate, commercial, customer service team, or their related parties for the same intent. Rude, offensive, or abusive behavior towards staff may result in the suspension of all services and access to the Site, including permanent deactivation of your account.
• Use the Application in any manner not permitted by this policy or exceed in any way the scope of our services for which you registered (i.e., accessing and using tools to which you do not have explicit rights obtained through a legitimate agreement).

Disclaimer and Warranty

Our site and its content are provided on an as-available basis and according to our current capabilities, without any form of warranty. We disclaim all warranties, express or implied, to the fullest extent permitted by law, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement, and those arising by statute or otherwise by law or trade practices. We make no representation or warranty whatsoever regarding this site, its completeness, accuracy, correctness, integrity, reliability, timeliness, suitability, fitness, functionality, availability, or operation of this site or the content or services provided on this site or accessible through it. We do not guarantee the operation of this site without interruption, free from errors, or that this site can be maintained free of viruses or other harmful components.

You agree to indemnify and hold harmless iEvolution, and its parent companies, subsidiaries, affiliates, officers, agents, co-branding partners, licensors, and employees, and release them from any and all claims or demands, including reasonable attorney's fees, made by any third party due to or arising from your Content, your use of this Site, your connection to the Site, your violation of these Terms or any other applicable policy, your violation of the rights of any other, or breach of any representation or warranty by you under these Terms, whether you are a registered user or not. You are solely responsible for your actions when using the Site, including, but not limited to, costs incurred for Internet access.

Limitation of Liability

Under no circumstances shall we be liable or assume responsibility for any direct, indirect, special, incidental, or consequential damages arising from or in connection with the use or inability to use this site, the content, or services provided on this site, or otherwise, insofar as liability rests fully with the user.

If, notwithstanding other provisions of these Terms, iEvolution is found to be liable to you for any damages or losses whatsoever arising from or related in any way to your use of the site or any content, iEvolution's liability shall in no case exceed US$100.00, an amount you agree to upon acceptance of this document, as permissible in your jurisdiction.

Confidentiality

Through the company's various distribution programs, users may gain access to certain media containing valuable company information. Such information shall be governed by confidentiality policies considered according to the regulations of each specific program.

General Terms

7.1 Errors and Corrections

Although we make reasonable efforts to include correct and up-to-date information on our Site, we do not warrant or represent that this Site will be free of errors. Data entry errors and other technical problems may occasionally result in incorrectly displayed information. We reserve the right to correct inaccuracies or typographical errors on our Site, including prices and availability of products and services, and shall not be liable for such errors. 7.2 Applicable Laws

Except to the extent applicable to special programs with their own agreement, these terms are governed by the laws of the State of Wyoming with an exclusivity agreed upon by consenting to this agreement.

If any provision of these Terms is found to be illegal, invalid, or for any reason unenforceable, then that provision shall be deemed severed and shall not affect the validity or enforceability of any remaining provision.

We reserve the right, at our sole discretion, to change these Terms at any time. Updated versions of these Terms will be posted here on our Site and will be effective immediately. The date of the most recent version is posted below. Please review frequently, especially before using the Site, to see if these Terms have changed.
