Your privacy matters to us. This policy explains how we collect, use, protect, and share your personal information.

This Privacy Policy is provided by iEvolution Pro LLC ("iEvolution," "iEvo," "we," "our," or "us") and applies to all personal information collected through our website, mobile applications, the my iEvolution virtual office, and any other platforms or channels we operate (collectively, the "Site").

This policy applies both to Customers, meaning anyone who buys iEvolution products at retail, and to Members, meaning holders of an active iEvolution Wholesale Membership. Section 02 describes information we collect only from Members.

By accessing or using our Site, you consent to the collection, use, and disclosure of your personal information as described in this Privacy Policy. If you do not agree with the practices described here, please discontinue use of our Site. This policy supplements the iEvolution Terms & Conditions. We encourage you to read both documents carefully.

Information We Collect

1.1 Personal Information You Provide

We collect personal information that you voluntarily provide when you create an account, place an order, subscribe to communications, or otherwise interact with our Site. This includes:

a. Identity Information: Full name, date of birth, and any government-issued identification where required for verification purposes.
b. Contact Information: Email address, phone number, billing address, and shipping address.
c. Payment Information: Credit or debit card numbers, billing details, and other financial information necessary to process transactions. Payment data is processed through secure, PCI-compliant third-party payment processors and is not stored on our servers.
d. Account Credentials: Username, password, and security questions used to access your iEvolution account.
e. Order History & Preferences: Records of past purchases, product preferences, wish lists, and any saved settings associated with your account.

1.2 Information Collected Automatically

When you visit our Site, we automatically collect certain information about your device and browsing activity through cookies, pixels, and similar tracking technologies. This may include:

a. Device Information: IP address, browser type and version, operating system, device type, and unique device identifiers.
b. Usage Data: Pages visited, time spent on pages, links clicked, referring URLs, and navigation patterns throughout our Site.
c. Location Data: General geographic location inferred from your IP address.
d. Referral Attribution: Where you arrive through a Member's affiliate or referral link, we record which link you used in order to attribute the sale and calculate commissions.

1.3 Information from Third Parties

We may receive information about you from third-party sources, including payment processors, shipping carriers, analytics providers, and advertising partners, which we may combine with other information we hold about you to improve our services and communications.

Information We Collect from Members

If you hold a Wholesale Membership, we collect additional information necessary to operate the Membership program, calculate and pay commissions, and meet our tax and reporting obligations.

2.1 Categories

a. Tax Information: Taxpayer identification number, Form W-9 or its local equivalent, and the information required to issue an IRS Form 1099-NEC or an equivalent statement.
b. Payout Details: The bank account, wallet, or other payment destination you provide to receive commission withdrawals.
c. Commission Records: Sales attributed to your affiliate links, commissions credited, reversals applied, withdrawals made, and your E-Wallet balance history.
d. Referral Relationships: The identity of your Sponsor, and the identity of Members who enrolled through your referral link.
e. Compliance Records: Complaints, investigations, and enforcement actions under the Member Code of Conduct, and content you publish that we review for compliance.

2.2 What Your Sponsor Can See

Member visibility

Because a Sponsor earns a referral commission on purchases made by the Members they referred, your Sponsor can see, in their virtual office, that you enrolled through their link, the date you enrolled, your first name and last initial, whether your Membership is active, and the commission amounts generated by your orders.

Your Sponsor cannot see your full contact details, your address, your payment information, your tax information, your payout details, your E-Wallet balance, or the itemized contents of your orders.

We do not disclose Member lists, contact information, or account data to other Members beyond what is described above.

2.3 What Members Can See About Customers

A Member who generates an affiliate sale can see that a sale occurred, its date, and the commission it produced. A Member does not receive the Customer's name, contact details, address, or payment information from us, and we do not provide Customer lists to Members. Where a Member ships product to their own buyer from their own stock, any information that buyer gives the Member is collected by the Member, not by us, and the Member is responsible for handling it lawfully.

How We Use Your Information

We use the personal information we collect for the following purposes:

3.1 Order Processing & Fulfillment

To process and fulfill your orders, manage payments, arrange shipping and delivery, send order confirmations and updates, and handle returns and exchanges in accordance with our Refund & Return Policy.

3.2 Account Management

To create and manage your iEvolution account, authenticate your identity, maintain your preferences, and provide customer support related to your account activity.

3.3 Membership Administration

To operate the Wholesale Membership program: to apply your wholesale pricing, generate and track your affiliate links, attribute sales, calculate and pay commissions, apply reversals, administer renewals, issue tax forms, and enforce the Membership Agreement and Member Code of Conduct.

3.4 Marketing & Communications

To send you promotional emails, SMS messages, newsletters, and other marketing communications about our products, services, offers, and events. You may opt out of marketing communications at any time (see Section 07).

3.5 Analytics & Site Improvement

To analyze usage trends, measure the effectiveness of our marketing campaigns, improve the functionality and user experience of our Site, and develop new products and services.

3.6 Legal Compliance & Protection

To comply with applicable laws, regulations, and legal processes; to enforce our Terms & Conditions and other policies; to protect the rights, property, and safety of iEvolution, our users, and the public; and to detect, prevent, and address fraud, chargeback abuse, security issues, or technical problems.

Cookies & Tracking Technologies

4.1 What Are Cookies

Cookies are small text files placed on your device when you visit our Site. They help us recognize your browser, remember your preferences, and understand how you interact with our Site.

4.2 Types of Cookies We Use

a. Essential Cookies: Required for the basic operation of our Site, such as maintaining your session, processing transactions, and enabling security features. These cannot be disabled.
b. Attribution Cookies: Used to record which Member's affiliate or referral link brought you to the Site, so that sales are credited correctly. These are essential to the operation of the Membership program.
c. Analytics Cookies: We use Google Analytics and similar tools to collect anonymized data about site usage, including pages visited, session duration, and traffic sources.
d. Advertising Cookies: We use third-party advertising technologies, including Facebook Pixel and similar services, to deliver targeted advertisements, measure ad performance, and build audience profiles for remarketing purposes.
e. Functional Cookies: These remember your preferences (such as language, country, or currency) and provide enhanced, personalized features on our Site.

4.3 Managing Cookies

You may control and manage cookies through your browser settings. Most browsers allow you to refuse or delete cookies. Please note that disabling certain cookies may affect the functionality of our Site, and disabling attribution cookies may prevent a Member's referral from being credited. For more information on managing cookies, consult your browser's help documentation.

Sharing Your Information

We do not sell your personal information. We may share your information with third parties only in the following circumstances:

5.1 Service Providers

We share personal information with trusted third-party service providers who perform services on our behalf, including payment processing, order fulfillment, shipping and delivery, email and SMS marketing platforms, customer support tools, commission and affiliate tracking platforms, and data analytics. These providers are contractually obligated to use your information only for the purposes for which it was shared and in accordance with this Privacy Policy.

5.2 Advertising Partners

We may share certain usage data and identifiers with advertising platforms such as Facebook (Meta) and Google for the purpose of delivering targeted advertisements and measuring campaign performance. This data may include hashed email addresses, device identifiers, and browsing activity collected through cookies and tracking pixels.

5.3 Other Members

We share limited information with a Member's Sponsor as described in Section 2.2, and with a Member about their own affiliate sales as described in Section 2.3. We share nothing further between Members.

5.4 Legal Requirements

We may disclose your personal information if required to do so by law, or in the good-faith belief that such disclosure is necessary to comply with a legal obligation, court order, or legal process; protect and defend the rights or property of iEvolution; prevent or investigate possible wrongdoing in connection with our Site; or protect the personal safety of our users or the public.

5.5 Business Transfers

In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your personal information may be transferred as part of that transaction. We will notify you of any such change in ownership or control of your personal information.

5.6 SMS Consent & Mobile Information

No mobile information, including phone numbers and SMS opt-in data, will be shared with third parties or affiliates for marketing or promotional purposes. Information shared with subprocessors that help us deliver SMS messages (such as our SMS gateway provider) is strictly limited to that purpose, and those subprocessors are contractually prohibited from using it for any other reason. All other categories of personal information described in this Privacy Policy exclude text messaging originator opt-in data and consent; this opt-in data is never shared with any third party for marketing purposes.

Data Security

We implement commercially reasonable administrative, technical, and physical safeguards designed to protect your personal information from unauthorized access, use, alteration, and disclosure. These measures include encryption of sensitive data in transit, secure server infrastructure, access controls, and regular security assessments.

However, no method of transmission over the Internet or method of electronic storage is completely secure. While we strive to protect your information, we cannot guarantee its absolute security. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.

Your Rights & Choices

7.1 Opt-Out of Marketing Communications

You may opt out of receiving marketing emails and SMS messages from iEvolution at any time. To unsubscribe from emails, click the "unsubscribe" link included at the bottom of any marketing email. To opt out of SMS messages, reply "STOP" to any marketing text message. Please note that even after opting out of marketing communications, you will continue to receive transactional messages related to your orders, account activity, and, if you are a Member, your Membership and commissions.

7.2 Access & Correction

You have the right to access the personal information we hold about you and to request correction of any inaccurate or incomplete data. You may update certain information directly through your account settings, or you may contact our customer support team for assistance.

7.3 Data Deletion

Upon closure of your account, we will delete your personal information following a reasonable grace period, during which time we may retain certain data as necessary to comply with legal obligations, resolve disputes, enforce our agreements, and for legitimate business purposes such as maintaining financial records as required by law. After the grace period has expired, your personal data will be permanently deleted or anonymized.

For Members, commission records, tax records, and transaction histories are retained for the period required by tax and financial recordkeeping law regardless of account closure, and referral attribution records are retained for as long as they remain necessary to calculate amounts owed to or by other Members.

7.4 California Residents

If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA), including the right to know what personal information we collect, the right to request deletion, and the right to opt out of the sale of personal information. As stated in Section 05, we do not sell your personal information. To exercise your rights, please contact us using the information provided in Section 10.

7.5 Mexico Residents

If you are located in Mexico, your personal data is treated in accordance with the Ley Federal de Protección de Datos Personales en Posesión de los Particulares (LFPDPPP). You have the rights of access, rectification, cancellation, and opposition (derechos ARCO), and the right to revoke your consent or limit its use and disclosure. To exercise those rights, or to request our Spanish-language privacy notice (aviso de privacidad), contact us using the information in Section 10. We will respond within the periods required by that law.

Children's Privacy

Our Site is not intended for individuals under the age of eighteen (18). We do not knowingly collect, solicit, or maintain personal information from anyone under 18 years of age. If we become aware that we have collected personal information from a minor under 18 without verified parental consent, we will take steps to delete that information promptly. If you believe that a minor has provided us with personal information, please contact us immediately using the information provided in Section 10.

Data Retention

We retain your personal information for as long as your account is active or as needed to provide you with our services. Following account closure, we will retain your information for a reasonable grace period to fulfill the purposes outlined in this Privacy Policy, after which your data will be permanently deleted or anonymized. Certain information may be retained for longer periods where required by law, including financial transaction records, tax documentation, commission and payout records, and data necessary for the resolution of disputes or enforcement of our agreements.

Policy Changes

We reserve the right to update or modify this Privacy Policy at any time at our sole discretion. When we make changes, the revised policy will be posted on our Site and the version date at the top and bottom of this page will be updated. We encourage you to review this Privacy Policy periodically. Your continued use of our Site following any changes constitutes your acceptance of the updated Privacy Policy. For material changes that significantly affect how we handle your personal information, we will make reasonable efforts to notify you via email or a prominent notice on our Site.
