Acceptance & Eligibility

1.1 Acceptance of Terms

By using the Site or purchasing iEvolution products, you accept these Terms in full. If you are entering into these Terms on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms.

1.2 Eligibility

You must be at least eighteen (18) years of age and legally capable of entering into a binding contract under the laws of your jurisdiction to use the Site or purchase our products. The Site is not directed to minors, and we do not knowingly collect information from individuals under 18.

1.3 Geographic Availability

iEvolution products are sold and shipped within the United States and Mexico. Customers outside these countries are not eligible to purchase directly from the Site at this time. Availability of specific products may vary by region.

Account Registration

2.1 Creating an Account

Certain features of the Site, including order tracking and subscription management, require you to create an account. You agree to provide accurate, current, and complete information during registration and to keep that information updated.

2.2 Account Security

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately at support@ievolutionpro.com of any unauthorized access or suspected security breach. We are not liable for any loss arising from your failure to maintain the confidentiality of your credentials.

2.3 One Account per Person

Each individual may maintain only one active customer account. Creating multiple accounts to circumvent promotional limits, abuse referral programs, or otherwise gain undue benefit may result in suspension or termination of all involved accounts.

Products, Pricing & Orders

3.1 Product Descriptions

We make reasonable efforts to display product information, images, and descriptions accurately. However, we do not warrant that product descriptions, colors, packaging, or other content on the Site are error-free, complete, or current. Product formulations and labeling may be updated from time to time.

3.2 Pricing

All prices are displayed in U.S. dollars (or local currency where indicated) and are exclusive of applicable taxes, shipping fees, and any other charges unless expressly stated. Prices may change at any time without prior notice. The price applicable to your order is the price displayed at the time you complete checkout.

3.3 Promotional Pricing

Promotional pricing, discount codes, and limited-time offers are valid only during the applicable promotional period and subject to any additional terms disclosed at the time of the offer. Promotional pricing is not retroactive and does not apply to previously completed orders. We reserve the right to modify or cancel any promotion at our sole discretion.

3.4 Order Acceptance

Your submission of an order constitutes an offer to purchase. We reserve the right to accept or decline any order, in whole or in part, at our sole discretion, including but not limited to orders that appear fraudulent, exceed reasonable quantity limits, contain pricing errors, or originate from locations we do not serve. If we cancel an order after payment has been processed, we will issue a refund to the original payment method.

3.5 Payment

We accept payment through the methods displayed at checkout, including major credit and debit cards and PayPal. By providing payment information, you represent that you are authorized to use the payment method and authorize us to charge the full order amount, including taxes and shipping. Payment data is processed by PCI-compliant third-party processors and is not stored on our servers.

3.6 Subscriptions & Auto-Renewal

Certain products and memberships are offered on a recurring subscription basis. By subscribing, you authorize us to charge your payment method automatically at the interval disclosed at the time of purchase until you cancel. You may cancel a subscription at any time through your account dashboard or by contacting customer support. Cancellation takes effect at the end of the then-current billing period; we do not provide refunds for partial periods unless required by law.

Shipping & Delivery

4.1 Shipping Destinations

We currently ship to addresses within the United States and Mexico. We do not ship to PO Boxes for certain product categories or to freight forwarders. International orders outside these countries are not accepted directly through the Site.

4.2 Processing & Transit Times

Orders are typically processed within one to three (1–3) business days after payment is confirmed. Transit times depend on your location and the shipping method selected at checkout. Processing and transit times are estimates and are not guaranteed.

4.3 Risk of Loss

Risk of loss and title to products pass to you upon delivery to the carrier. We are not liable for delays, losses, or damages caused by the carrier after products leave our facility, except as required by applicable law.

4.4 Address Accuracy

You are responsible for providing a correct and complete shipping address. We are not liable for orders that fail to deliver due to incorrect, incomplete, or outdated addresses. Reshipment to a corrected address may incur additional charges.

Returns, Refunds & Cancellations

Returns, refunds, and order cancellations are governed by our Refund & Return Policy, which is incorporated by reference into these Terms. Please review that policy carefully before placing an order. In the event of a conflict between these Terms and the Refund & Return Policy, the Refund & Return Policy controls with respect to the subject matter it addresses.

Product & Health Disclaimers

6.1 Dietary Supplement Statements

Statements regarding dietary supplements sold by iEvolution have not been evaluated by the U.S. Food and Drug Administration. Our products are not intended to diagnose, treat, cure, or prevent any disease.

6.2 Consult a Health Professional

The information provided on the Site is for general informational purposes only and is not medical advice. Always consult a qualified health professional before starting any supplement program, especially if you are pregnant, nursing, taking medication, or have a known medical condition. Discontinue use and consult a medical professional if you experience any adverse reaction.

6.3 Individual Results

Results from the use of dietary supplements vary by individual and depend on numerous factors including diet, lifestyle, genetics, age, and overall health. Testimonials reflect individual experiences and are not representative of typical results. We make no guarantee that you will achieve specific results from the use of any product.

6.4 Allergens & Ingredient Information

Product ingredient lists and allergen information are provided on each product page and on the product label. It is your responsibility to review ingredient information prior to use, particularly if you have known allergies or sensitivities.

SMS / Text Messaging Program

7.1 Program Description

The iEvolution SMS Notifications Program ("SMS Program") allows customers to receive text messages from iEvolution Pro LLC. By opting in, you consent to receive recurring marketing and transactional text messages, including but not limited to promotional offers, product launches, sale announcements, order confirmations, shipping notifications, abandoned cart reminders, customer care responses, and account-related communications.

7.2 Opt-In and Consent

You can opt in to the SMS Program by entering your mobile phone number on our website signup form or during checkout and affirmatively checking the SMS consent box. By providing your mobile number and checking the consent box, you agree to receive recurring automated text messages from iEvolution at the number provided. Consent to receive marketing text messages is not a condition of any purchase.

7.3 Message Frequency

Message frequency varies. You may receive up to ten (10) marketing messages per month, in addition to transactional messages related to your orders and account as needed.

7.4 Message and Data Rates

Message and data rates may apply. iEvolution does not charge for the text messages it sends, but standard messaging and data rates from your wireless carrier may apply. Please check with your carrier for details about your plan.

7.5 HELP and STOP Keywords

You can manage your participation in the SMS Program at any time using the following keywords:

7.6 Re-Subscription

If you wish to re-subscribe to the SMS Program after opting out, you may do so by opting in again through our website signup form or during checkout.

7.7 Eligibility

The SMS Program is available only to U.S. residents who are at least eighteen (18) years of age and who own or have legal authority to use the mobile phone number provided. By opting in, you confirm that you meet these eligibility requirements.

7.8 Supported Carriers

The SMS Program supports major U.S. wireless carriers, including AT&T, Verizon, T-Mobile, US Cellular, Boost Mobile, Cricket Wireless, Metro by T-Mobile, and others. Carriers are not liable for delayed or undelivered messages.

7.9 Privacy

Your information is handled in accordance with our Privacy Policy. We do not share, sell, or lease your mobile information or SMS opt-in consent data with third parties or affiliates for marketing purposes.

7.10 Changes to the SMS Program

iEvolution reserves the right to modify, suspend, or discontinue the SMS Program at any time without prior notice. Material changes will be communicated through the Site or via SMS where appropriate.

Intellectual Property

8.1 Ownership

All content on the Site, including but not limited to text, graphics, logos, images, product names, formulations, videos, and software, is the property of iEvolution Pro LLC or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.

8.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for personal, non-commercial purposes and to purchase products in accordance with these Terms. No other rights are granted, expressly or by implication.

8.3 Restrictions

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content from the Site except as expressly permitted by these Terms or with our prior written consent. Use of our trademarks, logos, or brand identity in connection with any product or service that is not iEvolution's, or in any manner likely to cause confusion, is strictly prohibited.

8.4 User-Generated Content

If you submit reviews, comments, testimonials, photographs, or other content to the Site or to our social media channels, you grant iEvolution a worldwide, royalty-free, perpetual, transferable, sublicensable license to use, reproduce, modify, adapt, publish, and display that content in connection with our business. You represent that you own or control all rights to the content you submit and that the content does not violate the rights of any third party.

Prohibited Conduct

You agree not to engage in any of the following activities when using the Site or interacting with iEvolution:

Disclaimer of Warranties

EXCEPT AS EXPRESSLY PROVIDED IN THESE TERMS OR AS REQUIRED BY APPLICABLE LAW, THE SITE AND ALL PRODUCTS ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, IEVOLUTION DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, nor that any defects will be corrected. We make no warranty regarding the accuracy, reliability, or completeness of any information on the Site.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL IEVOLUTION PRO LLC, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING WITHOUT LIMITATION DAMAGES FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, OR ANY OTHER INTANGIBLE LOSSES — ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR OUR PRODUCTS, REGARDLESS OF THE LEGAL THEORY ON WHICH THE CLAIM IS BASED AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THESE TERMS, THE SITE, OR ANY PRODUCT SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT PAID BY YOU TO IEVOLUTION DURING THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO THESE LIMITATIONS MAY NOT APPLY TO YOU IN FULL.

Indemnification

You agree to indemnify, defend, and hold harmless iEvolution Pro LLC and its affiliates, officers, directors, employees, agents, and licensors from and against any claims, demands, losses, liabilities, damages, and expenses, including reasonable attorneys' fees, arising out of or related to: (a) your use or misuse of the Site or our products; (b) your violation of these Terms or any applicable law; (c) your violation of any third-party right, including any intellectual property or privacy right; or (d) any content you submit to the Site.

Governing Law & Dispute Resolution

13.1 Governing Law

These Terms and any dispute arising out of or related to them, the Site, or our products are governed by the laws of the State of Wyoming, United States of America, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

13.2 Informal Resolution

Before initiating any formal legal action, you agree to first attempt to resolve any dispute by contacting our customer support team at support@ievolutionpro.com. Most disputes can be resolved informally and promptly through direct communication.

13.3 Venue

To the extent permitted by law, any legal action that is not subject to informal resolution shall be brought exclusively in the state or federal courts located in Wyoming, and you consent to the personal jurisdiction of those courts.

13.4 Class Action Waiver

To the fullest extent permitted by applicable law, you and iEvolution agree that any dispute shall be resolved only on an individual basis and not as a plaintiff or class member in any purported class, collective, or representative proceeding. This waiver does not preclude either party from participating in a class-wide settlement of claims.

Modifications to These Terms

We reserve the right to modify these Terms at any time at our sole discretion. When we make material changes, we will update the version date at the top and bottom of this page and may provide additional notice (such as a banner on the Site or a notification to your account). Your continued use of the Site after the effective date of the revised Terms constitutes acceptance of those changes. If you do not agree to the revised Terms, you must discontinue use of the Site.

General Provisions

15.1 Entire Agreement

These Terms, together with the Privacy Policy, the Refund & Return Policy, and any other policies referenced on the Site, constitute the entire agreement between you and iEvolution regarding the Site and our products, and supersede all prior agreements, understandings, or representations on the subject.

15.2 Severability

If any provision of these Terms is held invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall remain in full force and effect.

15.3 No Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of that right or provision. No waiver of any provision shall be effective unless made in writing and signed by an authorized representative of iEvolution.

15.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempted assignment in violation of this section is void. We may assign these Terms, in whole or in part, without restriction.

15.5 Independent Contractors

Nothing in these Terms creates a partnership, joint venture, employment, agency, or franchise relationship between you and iEvolution. The Code of Conduct for Independent Representatives is a separate agreement that applies only to Representatives enrolled in iEvolution's authorized partner program; it does not apply to Customers.

15.6 Force Majeure

We will not be liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, war, terrorism, civil unrest, government action, labor disputes, supply chain disruptions, pandemics, or interruptions of internet, telecommunications, or utility services.
